CASE OVERVIEW

The Supreme Court of India handed down its decision in Justice K.S. Puttaswamy (Retd.) v. Union of India, simply known as the “Aadhaar” case. v. The Supreme Court of India handed down its decision on Aadhaar in 2018, which changed the way privacy, technology, and government authority work together.

The Supreme Court considered and ruled on whether the Aadhaar Act is consistent with the Indian Constitution and what impact it has on people’s privacy rights, how their data is protected, and how welfare programs should work.

The Internet Freedom Foundation led other petitioners in taking the Court to investigate how the Aadhaar program threatens legal protections under the Indian Constitution.

The case highlighted three main concerns related to privacy:

  • how large personal data collections can be,
  • what balance between privacy and data collection is appropriate, and
  • what should be done to prevent government agencies from misusing personal information.
